GENERAL TERMS AND CONDITIONS OF SALE

1.        These General Terms and Conditions of Sale determine the contractual relationship established between Sarl MONACO RIVIERA NAVIGATION (hereinafter “MRN”) for, situated 8 Quai l’Hirondelle, MC 98000 Monaco and the Client, resulting from the purchase of (a) seat(s) on board a boat moored in the Monaco Harbour, known as “Port Hercule”, during the Monaco Automobile Grand Prix (hereinafter the “Event”), including practice sessions and races in Formula 1 and other categories, to take place on Friday, Saturday and Sunday.

2.        The “Client” is hereby designated as any person who purchases a ticket on the boat as well as the services offered by MRN, directly or through an intermediary (third person, agency, company staff committee, etc.). Clients purchasing their tickets directly acknowledge that they have been made aware of these General Terms and Conditions of Sale and accept them unconditionally.

3.        Intermediaries purchasing one or more boat tickets on behalf of one or more persons to whom they then pass on the ticket(s) acknowledge that they have been made aware of these General Terms and Conditions of Sale and accept them unconditionally. They undertake to bring them to the attention of the person(s) that will make use of the ticket(s), who is (are) de facto bound by this commitment.

4.        Reservations will only be considered:

a.        Upon reception by MRN of this document, duly completed, dated and signed by the Client or by the intermediary (business stamp mandatory for companies or any entity other than a private individual), accompanied by the full payment.

b.        Upon payment of the invoice sent by MRN and thus confirming the acceptance of the General Terms and Conditions of the Sale.

5.        Confirmation will then be sent to the Client by return and by any means available. The reservation will only become effective when this confirmation is sent by MRN.

6.        Each ticket is personal and non-exchangeable. MRN must be informed of any name change prior to the Event. In the case that MRN is not informed and has not granted an agreement, the new person will have to leave the boat by their own means (taxi boat at their own expense).

7.        A list of names of each client on board will be established for each day and sent to the Monegasque authorities.

8.        The information regarding each client is saved by MRN for marketing needs and any possible request from the Monegasque port or maritime police authorities. They remain accessible to the clients who can, at any time, read them and request the modification of their content.

9.        MRN reserves the right to refuse any confirmation/request that it considers to be incomplete or that it deems unacceptable, without needing to provide justification thereof.

10.     No cancellations can be made by the Client after seven (7) full days from the confirmation sent by MRN.

11.     The tickets, as well as the various instructions, shall be either deposited at an address agreed upon with the Client, near the Principality (hotel, residence, etc.) three (3) days preceding the Thursday of the races, or sent by registered mail to the address indicated by the Client. MRN may not be held liable for any theft or loss of ticket(s) and/or pass(es) issued by the Automobile Club of Monaco and/or voucher(s) issued by MRN, that might render access to the circuit impossible. No duplicates can be issued.

12.     MRN has traditionally obtained a mooring with a view of the bend known as the Tobacco Bend. However, for reasons outside the control of MRN including “restraint of the Prince” (decisions of the Monaco Harbour authorities, race organization, etc.), this mooring may change when spaces are officially allocated a few days prior to the Event. MRN may not be held liable in such cases for misrepresentation.

13.     Should a major and unforeseeable incident prevent the boat from entering the Monaco Harbour for the Event (fire on board, engine failure in the days preceding the Event, collision at sea giving rise to a serious hull breach immobilising the boat, etc.), MRN will reimburse payments made by the clients as soon as possible. MRN may not, however, be held liable for damages and/or compensation should the day on board be cancelled for reasons outside its control.

14.     In the event of an unexpected event (“force majeure”), as defined by Monegasque law and case law, preventing performance hereof, however, no money will be refunded to the Client under any circumstances.

15.     MRN may not be held liable for any changes of the dates and/or times of the Event for any reason whatsoever.

16.     For reasons of safety and comfort, children under 12 years of age (on the day of the Event) shall not be allowed on board the boat, except with an exceptional approval granted by MRN Management. Responsibility for any minor children on board during the Event shall be incumbent solely upon their parent(s) or those accompanying the children.

17.     The Client declares that they have been informed of the fact that they may be asked to show an identity card or other identification document at any time by the Event organisers or officials, at checkpoints, in order to board the boat, and confirms that he or she is able to comply with any request in this regard.

18.     The Client authorises MRN to use any photographs or video footage taken during the Event, in which the Client may appear, for marketing purposes. Photographs and videos may be reproduced on any type of media, including Internet and social networks.

19.     Since the consumption of beer, wine, champagne, aperitifs and liqueurs is permitted on board, as well as water, fruit juice and other soft drinks, the Client undertakes to drink responsibly and remains solely responsible for his / her behaviour and any consequences (falls on board, on taxi boat, etc.).

20.     MRN staff reserve the right to refuse to continue to serve any client that they believe is showing signs of having drunk too much alcohol.

21.     Alcohol consumption by minors is strictly prohibited

22.  Courteous and polite behaviour is required on board with regards to other clients, crew members and staff. Any signs of disrespectful behaviour will lead to the immediate expulsion of the Client and/or accompanying persons, accompanied by the maritime police authorities. No refunds may then be requested.

23.   This document is governed solely by Monegasque law, excluding any other. In the event of a dispute, the parties shall enter into negotiations with a view to amicable resolution. If no solution can be found, the dispute shall then be referred to the only courts of the Principality of Monaco.

Some rules to follow onboard:

·         Proper, casual clothing is mandatory onboard, and we suggest that you wear comfortable shoes. We strongly recommend that you bring hats/caps, sunscreen, etc.

·         You may be asked for your ticket and ID by the Grand Prix officials before you access the water taxi dock. Do not forget to carry your ID and ticket at all times, as requested.

·         Courteous and respectful behaviour around other passengers, crew and staff is mandatory.

·         Once onboard, if these rules are not respected, you may be subject to immediate expulsion from the boat, no refunds will be given.
